The dispute arose from the annulment of personnel delegate elections based on an agreement organized by two separate, identically worded protocols signed on different dates by the employer and each of the two existing unions. The lower court annulled the elections, reasoning that separate signings violated the requirement for all representative worker organizations to participate in the elaboration of a single protocol. However, the high court quashed this decision, holding that while the agreement must be concluded with all representative unions, there is no legal requirement for all unions to sign the protocol simultaneously or on the same document, thereby finding the lower court had illegally added conditions to the existing law.
