Synthèse Legislator

The Commercial Court, upon finding that the claimed sums were unrelated to the defendant's commercial activities, declared itself incompetent and referred the parties to pursue their claims as they saw fit, which judgment was confirmed by the Court of Appeal. The Supreme Court quashed the appellate ruling because, by confirming the lower court's decision without designating the competent jurisdiction as required by the relevant decree, the Court of Appeal violated that article.
