An employer appealed a decision ordering it to pay a former worker's seniority bonus, arguing that the subsequent hourly wage increase in August 1970 effectively incorporated the 15% bonus, or at least compensated for the reduction in working hours without including the bonus. The appellate court ruled that the hourly wage increase was solely intended to offset the shorter work duration, not to absorb the existing seniority bonus, which therefore remained payable separately. The high court rejected the appeal, affirming that the lower court, by examining the parties' common intention, reasonably concluded that the seniority bonus had not been merged into the new hourly rate but persisted independently, making the residual payment due.

ALORS, QUE D'UNE PART, DE TELS MOTIFS SONT ENTACHES DE CONTRADICTION, ALORS QUE D'AUTRE PART, IL RESULTAIT DES DOCUMENTS DE LA CAUSE DENATURES PAR LA COUR D'APPEL ET QU'IL AVAIT TOUJOURS ETE SOUTENU PAR LA SOCIETE, SANS AUCUNE CONTESTATION DE LA PART DU SALARIE, QUE LA REMUNERATION HORAIRE DE CELUI-CI ETAIT PASSEE DE 5,82 FRANCS A 7,19 FRANCS, SOIT UNE AUGMENTATION DE PRES DE 25%, LE NOUVEAU SALAIRE ETANT PAR CONSEQUENT SUPERIEUR AU SALAIRE ANCIEN AUGMENTE DE LA PRIME D'ANCIENNETE DE 15%;
