In a case where an explosion and fire occurred during wood treatment services, causing damage, the property owner and their insurer sued the contractor and its insurer for damages, despite the owner having paid the invoice without reservation. The contractor appealed the lower court's ruling, arguing that the payment extinguished contractual liability claims not expressly reserved and that the lower court incorrectly shifted the burden of proof regarding the timing of payment. The high court rejected this first argument, reasoning that in a bilateral contract, payment made without reservation does not waive a claim for non-performance or poor performance, as a waiver of rights is not presumed, thus justifying the lower court's decision. The second ground of appeal, challenging the basis of contractual liability regarding prudence and diligence during execution, was also rejected because the appellate court correctly distinguished between the breach of the contract's main obligations and the breach of the ancillary duty of care, thereby upholding the contractor's liability based on the fault of itself or its employees during the contract's execution.
