An employee of a family allowance fund issued payment vouchers in the names of third parties for benefits they were not due, subsequently collecting the amounts from those individuals, including one person who was told by the employee that he was collecting sums due to her and subsequently handed over 4572.40 francs, leading the fund to sue that person for reimbursement of the overpayment. The appellate court rejected the claim, reasoning that the transfer of funds was merely part of an embezzlement scheme and not a payment subject to restitution. The high court quashed this decision, holding that by failing to investigate whether the recipient had knowingly received sums improperly paid by the fund due to the deceit of its employee, the appellate court failed to provide a legal basis for its judgment under the relevant article concerning the restitution of undue payments.
