The insurer sought to apply a prime surcharge to the insured following a traffic accident, based on a contract clause exempting the surcharge only when the insured proves the total responsibility of an identified third party at the time of declaration. The insured argued that requiring a final judicial decision dismissing liability or prescription to meet this exemption unduly restricted the clause's scope, allowing the insurer discretionary power to raise premiums whenever an accident occurred without a definitive ruling against the insured. The High Court overturned the appellate court's decision for failing to address this critical argument regarding the scope and application of the contractual clause concerning the imputation of responsibility.
