In an appeal against a summary judgment ruling to enforce a resolutory clause in a commercial lease due to non-payment of rent, the appellant tenant, whose representation by counsel was mandatory, limited its appellate submissions to alleging a serious dispute regarding the underlying command and requesting the dismissal of the summary proceedings. The appellate court erred, in violation of the procedural rules mandating that the court rule only on conclusions filed and joined to the file, by granting the tenant the benefit of specific statutory delays when the request for such delays was made orally at the hearing and not formally submitted through written conclusions.
