The appellate court correctly ruled that a 1967 decree, issued under the 1948 tenancy law, applies generally to all premises covered by that law, including those leased to legal entities, irrespective of whether the rent was freely agreed upon or determined under specific articles of the 1948 law. The central issue being the exercise of the right to remain in the premises, the court reasoned that the decree's applicability depends only on whether the property fits objectively into the exceptional or Category I classifications defined in the 1948 decree's annex, regardless of any prior classification agreed upon by the parties, leading to the rejection of the appeal which argued that premises whose rent was not subject to scientific rent fixing could not be subject to the decree.
