The case involves an appeal of a summary judgment decision ordering a party to pay a specific sum under penalty, where the subsequent appellate court ruling failed to mention that the mandatory written report from the rapporteur judge, required under the Code of Civil Procedure for proceedings where legal representation is obligatory (such as an appeal of a summary judgment), had been presented at the hearing. The high court quashed the appellate decision, finding that this omission constituted a violation of the cited procedural articles, and consequently referred the case back to a different court of appeal for a new ruling.
