The court quashed a ruling that denied an existing right-of-way servitude upon the division of two properties, because the lower court erred by basing its decision on a subsequent deed from 1959, which contained declarations from the sellers about the absence of servitudes, instead of examining the situation at the time of the initial division of the property in 1958, as required by the article of the Civil Code concerning servitudes by destination of the original owner.
