Synthèse Legislator

Généré par l'IA

The court first rejected an exception of inadmissibility, holding that an argument concerning the prerequisite of paying contributions before seeking a reduction of late payment surcharges was receivable because the underlying contribution amounts were already contested before the lower court. On the merits, the court quashed a prior decision that had entirely remitted late payment surcharges, reasoning that the relevant decree mandated that any request for reduction of such surcharges, even based on good faith, could only be ruled upon after the totality of the contributions to which the surcharges applied had been paid, thereby sending the case back to a different first-instance commission for proper determination.
