The Court of Cassation quashed a lower court's ruling that entirely invalidated a contractual clause limiting a contractor's liability, reasoning that while the ten-year warranty established by the Civil Code is a matter of public policy and voids total exemption clauses, partial limitations on liability, such as one restricting the contractor's responsibility to the cost of the work performed, are permissible and legally justifiable.
