Appeal Jurisdiction in Animal Sale Dispute over Principal and Interest
Synthèse Legislator
Généré par l'IAIn a dispute where purchasers sued a seller for 1,450 francs principal plus related expenses and interest stemming from an animal sale, the Court of Appeal declared the appeal inadmissible based solely on a statute stating commercial courts rule without appeal for claims whose principal does not exceed 1,500 francs. The high court quashed this decision, reasoning that by limiting its ruling only to the principal amount while ignoring that the total interest in the dispute exceeded the final appeal threshold, the Court of Appeal violated the relevant commercial code provision concerning jurisdiction limits for appeals.
