The Court of Cassation quashed an appellate decision that declared a lower court judge incompetent to rule on the eviction of an individual from property previously taken by expropriation in 1945, on the grounds that the objections raised by the expropriated party constituted execution difficulties falling under the exclusive jurisdiction of the expropriation judge as per the decree of November 20, 1959. The High Court reasoned that the special jurisdiction conferred by that decree only applies to difficulties concerning decisions rendered *under* that specific 1959 decree, meaning the appellate court erred in declining jurisdiction over issues related to an expropriation ordered under a prior 1945 ordinance.
