A licensee in Switzerland, granted exclusive rights to exploit a patent and trademark for an elastic fabric in Switzerland and Great Britain, ceased paying royalties upon discovering that finished goods made in Germany and Austria by other licensees were being imported into Switzerland, thereby obstructing the exploitation of their license. The licensor sued for contract termination and payment of royalties, while the licensee counterclaimed for termination due to the licensor's failure to provide the promised guarantee. The Court of Cassation overturned the appellate court's decision, finding that the appellate court erred in limiting the scope of the exclusive patent license, which inherently grants a manufacturing and sales monopoly extending to articles made with the patented fabric unless expressly restricted, and in improperly applying terms from foreign contracts to the Swiss licensee. Furthermore, the appellate court failed to provide reasoning for dismissing the claim regarding the trademark license infringement, violating legal requirements.
