Synthèse Legislator

Généré par l'IA

The appellate court wrongly denied a widow the right to remain in her dwelling, in a municipality where the general right of retention did not apply, on the basis that a 1965 decree freeing rents in that category of municipalities rendered the specific provision of Article 7 of the Law of September 1, 1948, which granted this right to occupants benefiting from provisions of the Family Code and Social Assistance, obsolete; the high court ruled that the decree did not have this consequence, thus violating the cited article.
