A challenge to the regularity of personnel delegate elections held on May 10, 1961, and May 10, 1962, was filed on May 23, 1962, on the basis that the number of elected delegates exceeded what was permitted by the number of employees. The lower court dismissed the entire challenge as inadmissible because it believed the dispute, concerning eligibility, should have been brought within the twenty-day period following the publication of electoral lists, referencing an outdated 1852 decree. The High Court partially quashed the decision, reasoning that the applicable 1951 law mandates that challenges to the regularity of elections, including those related to eligibility, must be brought within fifteen days of the election itself, and thus the dismissal of the challenge concerning the May 10, 1962, election was an error, remanding that part for retrial.
