The court declared an appeal inadmissible because the appellant prematurely served notice of the appeal to the opposing parties on April 27th, before formally filing the appeal petition with the registry on April 28th, which violates the strict legal requirement under the Decree of February 2, 1852, that the appeal must be filed first and then served within ten days, rendering the prior notice null and the appeal consequently untimely and not receivable.
