Where an employment contract for an indefinite term is terminated, damages for abusive rupture can only be awarded if the claiming party proves both prejudice and a legally imputable fault by the terminating party, beyond the mere failure to establish the validity of the initial accusation leading to dismissal. The lower court erred in condemning an employer for abusive rupture indemnity because it found the employer failed to prove alleged embezzlement, but it failed to identify any specific fault on the employer's part that would legally justify the damages, particularly as it provided no basis for the claim that the employer was obligated to re-receive the dismissed employees after termination.
