Appeal Inadmissibility Due to Untimely Filing After Partial Notification
Synthèse Legislator
Généré par l'IAThe court declared the appeal inadmissible because it was filed outside the statutory two-month period, which began running upon the notification of the decision, as required by the law governing appeals where the assistance of counsel before the high courts is not mandatory. The appellant contended the notification was invalid because it only contained the operative part of the decision, delaying the start of the appeal period until the full text was provided months later, but the court reasoned that a notification including both the reasons and the operative part satisfied legal requirements and duly initiated the appeal deadline, rendering the subsequent filing untimely against the decision rendered in October 1956 and notified in October 1956, despite the filing occurring in May 1957.

Vu l'article 36 de la loi du 23 juillet 1947, ensemble l'article 232 du Code de la sécurité sociale ;
Attendu que lorsque les parties sont dispensées par la loi du ministère d'un avocat au Conseil d'Etat et à la Cour de Cassation, le pourvoi est formé dans les deux mois à dater de la signification ou de la notification de la décision ;
Attendu que Duprat, agissant en vertu d'un pouvoir spécial au nom et comme mandataire de Fredon, a déclaré se pourvoir le 17 mai 1957, contre une décision de la Commission régionale d'appel de la sécurité sociale de Bordeaux, rendue le 8 octobre 1956, laquelle décision avait été notifiée le 11 octobre 1956 ;
Attendu que c'est à tort que Fredon soutient que la notification aurait été nulle parce que ne contenant que le dispositif de la décision attaquée et que le pourvoi serait valable, la copie intégrale de la décision lui ayant été remise seulement le 2 avril 1957 ce qui n'est pas contesté ;
