A claimant, asserting inability to work due to medical status proven by expertise, was denied family benefits as the head of household, with the benefits instead being allocated to his independently employed wife, because the appellate body failed to specify why the claimant was deemed not to be the head of the family or detail the evidence supporting his incapacity, thus preventing the highest court from exercising its review over the denial of benefits based on his salaried status.

MAIS ATTENDU QU'EN NE PRECISANT NI LES RAISONS POUR LESQUELLES LA QUALITE DE CHEF DE FAMILLE A ETE REFUSEE A X..., NI LES ELEMENTS DE L'EXPERTISE MEDICALE INVOQUEE PAR CE DERNIER POUR DEMONTRER SON IMPOSSIBILITE DE TRAVAILLER, LA COMMISSION REGIONALE D'APPEL QUI FAIT ETAT D'ALLEGATIONS DE LA CAISSE SANS INDIQUER LES VERIFICATIONS QUI ONT PU EN ETRE FAITES, N'A PAS MIS LA COUR DE CASSATION EN MESURE D'EXERCER SON CONTROLE SUR LE REFUS OPPOSE PAR LADITE CAISSE AU PAYEMENT DE PRESTATIONS FAMILIALES AU TITRE SALARIE;
