An independent worker sought exemption from family allowance contributions, but the appellate decision rejected the claim solely by applying a specific statutory provision without investigating whether the worker dedicated the requisite average time to the activity or derived normal means of existence from it, as required by the relevant decrees defining professional activity; the Court of Cassation quashed the decision for lack of legal basis, as it failed to establish the factual prerequisites necessary to determine the justification for the exemption request.
