The Finnish Labour Court dismissed the plaintiffs' request to interpret a collective agreement without a hearing. Consequently, the court ruled they lacked standing to initiate proceedings.

Työehtosopimuksen vastainen menettely

KANNE

Kantajat ovat vaatineet, että työtuomioistuin vahvistaa haastehakemuksesta ilmenevät, lentoliikenteen palveluja koskevan työehtosopimuksen osana sovellettavan ns. vakautussopimuksen tulkinnat.

KÄSITTELYRATKAISU

Perustelut

Työtuomioistuimesta annetun lain 17 §:n 1 momentin 1 kohdan nojalla kanne on haastetta antamatta jätettävä tutkimatta, jos haastehakemus on niin puutteellinen, ettei sitä voida ottaa oikeudenkäynnin perusteeksi.

Kanne perustuu Palvelualojen Toimialaliitto ry:n ja Ilmailualan Unioni IAU ry:n väliseen lentoliikenteen palveluja koskevan työehtosopimuksen osana sovellettavaan niin sanottuun vakautussopimukseen. Vakautussopimus on otettu työehtosopimuksen osaksi 26.8.2009. Haastehakemuksesta ja sen täydennyksestä on ilmennyt, että A ja C on erotettu IAU ry:hyn kuuluvasta Ilmailutekniikan Ammattiyhdistys ITA ry:stä 14.5.2008 ja että B on eronnut itse ITA ry:n jäsenyydestä 16.8.2009.

Kantajat eivät ole tulleet sidotuiksi vakautussopimukseen työehtosopimuslain 4 §:n nojalla, koska heidän jäsenyytensä ITA ry:ssä on päättynyt ennen kuin vakautussopimus on otettu työehtosopimuksen osaksi. Kantajilla ei siten ole työtuomioistuimesta annetun lain 12 §:n mukaista kanneoikeutta asiassa. Kanne on tästä syystä jätettävä tutkimatta.

Päätöslauselma

Kanne jätetään työtuomioistuimesta annetun lain 17 §:n 1 momentin 1 kohdan nojalla haastetta antamatta tutkimatta.

Työtuomioistuimesta annetun lain 17 §:n 2 momentin mukaan A, B ja C voivat saattaa asian tutkimista koskevan kysymyksen työtuomioistuimen ratkaistavaksi ilmoittamalla siitä kirjallisesti työtuomioistuimelle kahden viikon kuluessa päätöksen tiedoksi saamisesta.

Asian on ratkaissut presidentti Saloheimo. Esittelijänä on ollut Engblom.
