The Supreme Court upheld the conviction for tax fraud and the order to pay damages. Although the tax authorities later determined that the specific tax rates applied were in violation of EU law, this did not negate the defendant's intent to evade taxes at the time of the offense. The court ruled that the procedural outcome regarding the crime's definition and sentencing considerations remained valid despite the subsequent correction of the tax rates.

Hovioikeus oli tuominnut A:n rangaistukseen veropetoksesta ja velvoittanut maksamaan valtiolle vahingonkorvausta. A:n maksettavaksi määrätyt autovero ja arvonlisävero oli sittemmin todettu määrätyn Euroopan yhteisön perustamissopimuksen 90 artiklan vastaisesti liian korkeiksi.
