The Supreme Court of Finland allowed compensation claims arising from the Railway Administration's unauthorized excavation of a ditch on land recently expropriated for a temporary diversion area. The Railway Administration argued the work fell under the expropriation law's provisions regarding permanent property acquisition, while the claimant contended it constituted a separate tort requiring damages. The court ruled that since the land was only temporarily expropriated, the excavation did not qualify as a necessary measure under the expropriation statute and thus constituted a compensable interference with the claimant's rights.
