Hovioikeus oli hyväksynyt konkurssipesän A:ta vastaan ajaman takaisinsaantikanteen. A:n valituksen johdosta Korkein oikeus katsoi, ettei hovioikeus ollut lausunut A:n eräästä väitteestä, ja palautti asian hovioikeuteen. Uudessa käsittelyssä hovioikeus hylkäsi kanteen toisella perusteella, johon A oli oikeudenkäynnissä myös vedonnut. Konkurssipesä katsoi valituksessaan, ettei hovioikeus ottaen huomioon Korkeimman oikeuden palautusratkaisun perustelut olisi saanut ratkaista asiaa lausumallaan perusteella.
