The Supreme Court dismissed the employer's appeal against the lower court's decision regarding the dismissal of employee A. The employer argued that the client required a new welder, B, because A's skills were deemed insufficient, while A claimed the dismissal was unjustified. The court ruled that the employer could not successfully rely on the client's alleged requirement to justify the termination of A's employment contract.

A:n ollessa lomautettuna työnantajayhtiö oli saanut hitsausta koskeneen työn. Yhtiö ei ollut kutsunut A:ta työhön katsoen hänen ammattitaitonsa riittämättömäksi. Työhön oli palkattu uusi työntekijä B.

Kysymys siitä, saiko työnantajayhtiö vasta hovioikeudessa vedota siihen, että työn tilaaja olisi edellyttänyt B:n käyttämistä hitsaustyöhön.
