The Supreme Court of Finland allowed the Supreme Administrative Court's decision to acquit the defendant of intentional homicide under the excessive defense provision. The defendant killed his attacker after the attacker had stabbed him multiple times with a knife, an act the lower court deemed excessive. The court ruled that the defendant's reaction was justified given the immediate threat and the attacker's prior violent assault.

A oli veitsi kädessä läpsinyt avokämmenellä tytärtään B:tä kasvoihin uhaten samalla tappaa B:n ja tämän tyttären. B oli saanut veitsen pois A:lta ja lyönyt sillä A:ta useamman kerran ylävartaloon seurauksin, että A oli kuollut.

Kysymys siitä, oliko B, jonka hovioikeus oli tuominnut hätävarjelun liioitteluna tehdystä taposta, jätettävä rikoslain 3 luvun 6 §:n nojalla rangaistukseen tuomitsematta.
