Alioikeus on myöntäessään rikosasian vastaajalle maksuttoman oikeudenkäynnin määrännyt tämän velvolliseksi korvaamaan valtiolle määräosan sen varoista maksetuista, asian käsittelyn vaatimista menoista. Kysymys sanotun korvausvelvollisuuden määräämisen perusteista.

Kysymys myös siitä, että alioikeus on myöhemmin ratkaistessaan pääasian vahvistanut vastaajan valtiolle suoritettavan korvauksen määrän, vaikka korvausvelvollisuuden määräämistä koskevaa valitusta ei ollut lainvoimaisesti ratkaistu.
