Käräjäoikeus luki vastaajan syyksi törkeän lapsen seksuaalisen hyväksikäytön

(563/1998). Vastaaja vaati valituksessaan hovioikeudelle muutosta ainoastaan

rangaistusseuraamuksen osalta. Hovioikeus otti tutkittavakseen rikosnimikkeen

oikeellisuuden ja katsoi, ettei vastaajan syyksi luettu teko täyttänyt törkeän

tekomuodon ankaroittamisperustetta, ja hylkäsi syytteen vanhentuneena.

Kysymys hovioikeuden tutkimisvallasta.
