Turvapaikkaa hakeneet A ja B olivat kieltäytyneet riisumasta uskontonsa edellyttämää pään peittävää huivia turvapaikkahakemuksen rekisteröinnin yhteydessä poliisilaitoksella otettavaa valokuvaa varten. Vastaajina olevat poliisilaitoksen virkamiehet olivat voimakeinoja käyttäen pakottaneet A:n ja B:n riisumaan huivinsa valokuvauksen ajaksi.
