Ylioppilastutkintolautakunnalta oli pyydetty sähköisessä muodossa koulukohtaisia tilastotietoja ylioppilastutkinnon tuloksista. Pyydetyt tiedot sisältyivät ylioppilastutkintorekisteristä tuotettuun tulosluetteloon, joka oli julkisuuslain 16 §:n 2 momentissa tarkoitettu ratkaisurekisteri. Rekisteriin sisältyvät henkilötiedot ja muut tiedot, joita pyyntö ei koskenut, olivat teknisesti poistettavissa rekisteristä ilman uuden asiakirjan laatimiseen rinnastettavia ohjelmointitoimenpiteitä. Kun vaikeus erottaa salassa pidettävät tiedot julkisista tiedoista tai muukaan julkisuuslain 16 §:n 2 momentissa tarkoitettu erityinen syy ei näin ollen ollut esteenä pyydettyjen tietojen luovuttamiselle tulosluettelosta eikä tietojen antaminen merkinnyt uuden asiakirjan laatimista, ylioppilastutkintolautakunnan oli annettava pyydetyt tiedot tulosluettelosta sähköisessä muodossa.
