Fladaa koskevassa, tiepenkereen ja sillan rakentamista tarkoittavassa lupa-asiassa tuli vesilain 1 luvun 15 a §:n mukaisesti ensin tutkia, vaarantaako kyseessä oleva toimenpide enintään 10 hehtaarin suuruisen fladan säilymisen luonnontilaisena. Jos toimenpide vaarantaa fladan säilymisen luonnontilaisena, on toimenpide pykälän 1 momentin mukaan kielletty. Tämän jälkeen oli tutkittava, voidaanko tästä kiellosta myöntää mainitun pykälän 2 momentissa tarkoitettu poikkeus. Harkittaessa mahdollisuutta myöntää poikkeusta vesilain 1 luvun 15 a §:n mukaisesta kiellosta on pykälän 2 momentin mukaisesti selvitettävä, aiheutuuko tiehankkeen toteuttamisesta seuraus, joka vaarantaa huomattavasti kyseisen fladatyypin suojelutavoitteet.

Koska tiepenkereen ja sillan rakentaminen vaaransi fladan säilymisen luonnontilaisena, oli sanottu rakentaminen kielletty ilman vesilain 15 a §:n 2 momentissa tarkoitettua poikkeusta. Kun tiehankkeen toteuttamisesta aiheutui kyseisen fladatyypin suojelutavoitteiden huomattava vaarantuminen, ei poikkeusta voitu myöntää eikä lupahakemukseen voitu suostua.
