The Supreme Administrative Court ruled that income generated by a company established to continue a farmer's business must be taxed as the individual's income when no rent or wages were paid to the individual or others. The court found that the company's operations were merely a continuation of the individual's previous farming activities, lacking the true nature of a separate commercial enterprise. Consequently, the tax authority was permitted to assess the company's agricultural income against the individual taxpayer for the 1995 tax year.

A perusti verovuoden loppupuolella osakeyhtiön, jonka kaikki osakkeet hän merkitsi, jatkamaan harjoittamaansa maataloutta. Yhtiölle siirrettiin kaikki maatalouden varat ja velat, A:n yksityisasunnon sekä maa- ja metsäalueiden, noin 150 hehtaaria, jäädessä kuitenkin A:n omistukseen. Toiminta säilyi laajuudeltaan entisellään. Yhtiö ei ollut suorittanut vuokraa A:lle noin 100 hehtaarin maatalousmaan käyttämisestä eikä se ollut maksanut palkkaa A:lle eikä ulkopuolisille työntekijöille. Näissä olosuhteissa yhtiön toimintaa pidettiin A:n aikaisemmin harjoittaman toiminnan jatkamisena. Katsottiin, että maatalouden harjoittaminen yhtiön nimissä ei vastannut asian varsinaista luonnetta ja tarkoitusta ja yhtiön maatalouden tulo voitiin siten verottaa A:n tulona. Verovuosi 1995. Äänestys 6-2.
