Supreme Administrative Court allows adoption revocation when child's best interests are not compromised by return.
Legislator summary
AI generatedThe Supreme Administrative Court allowed the mother to revoke her consent to the adoption of her 18-year-old daughter. Although the child had been placed in foster care for adoption due to care deficiencies, the court found no compelling reason to prevent the return. The decision rests on the principle that the child's best interests must be weighed against the mother's right to custody, which prevails when the child is not at risk upon return.
Legislator headnote
