Lääkekorvauslautakunnassa (nykyään lääkkeiden hintalautakunta) päätöksentekoon lautakunnan jäsenenä oli osallistunut henkilö, joka oli allekirjoittanut lautakunnalle samasta asiasta annetun kansaneläkelaitoksen lausunnon. Huomioon ottaen lausunnon merkitys asiaa ratkaistaessa ja henkilön asema lausunnon antajana, hänen oli katsottava olleen hallintomenettelylain 10 §:n 1 momentin 6 kohdassa tarkoitetulla tavalla esteellinen osallistumaan lautakunnan jäsenenä asian käsittelyyn. Kun asian käsittelyssä oli näin ollen tapahtunut menettelyvirhe, korkein hallinto-oikeus kumosi lautakunnan päätöksen ja siirsi asian lääkkeiden hintalautakunnalle uudelleen käsiteltäväksi.
