Silent partner's uncollected profits from dissolved partnership are taxable as income despite inability to collect.
Legislator summary
AI generatedThe Supreme Administrative Court allowed the silent partner's claim to include uncollected partnership profits in his taxable income. Although the partner could not collect the funds due to the company's insolvency and dissolution, the court ruled that the right to the profits existed at the time of the fiscal year. Consequently, the tax authority was correct to tax these amounts as the partner's income regardless of subsequent collection difficulties.

A oli äänetön yhtiömies kommandiittiyhtiössä, jonka vastuunalainen yhtiömies kuoli 3.4.1992. Yhtiösopimuksen mukaan voitonjako tapahtui siten, että äänetön yhtiömies sai 25 % yhtiön voitosta muun osan mennessä vastuunalaiselle yhtiömiehelle. Verotuksessa yhtiön tilikauden 1.3.1991-29.2.1992 verotettavan tulon puolikkaasta jaettiin verotettavaksi A:n tulona 142.543 mk ja yhtiön tilikauden 1.3.1992-28.2.1993 elinkeinotoiminnan tuloksesta 95.897 mk.
