The Insurance Court overturned the unemployment benefits board's decision to deny benefits to a claimant whose variable work schedule averaged 60% of full-time hours. The claimant argued that his intermittent work periods and 60% salary payment proved he did not exceed the 75% full-time threshold, while the board initially denied benefits citing excessive hours. The court ruled in favor of the claimant because the lack of overtime pay for hours beyond the 60% average confirmed his employment did not surpass the statutory limit.
