A oli asunut isänsä työn vuoksi USA:ssa vuodesta 1992 lähtien eikä hänellä ollut ollut vakinaista kotikuntaa Suomessa tämän jälkeen. VakO katsoi, ettei A:n oleskelua ulkomailla voitu pitää tilapäisenä. A:lle ei näin ollen voitu myöntää opintotukea hänen USA:ssa harjoittamiaan opintoja varten. Opintotuen muutoksenhakulautakunnan päätöstä ei muutettu. Valitus hylättiin.
