Vakuutettu A työskenteli lossinkuljettajana. Hän oli työssään joutunut vuosien aikana useamman kerran huomauttamaan lossilla matkustanutta B:tä asiattomasta lossikäyttäytymisestä, mistä oli aiheutunut eripuraa heidän välilleen. Erään muusta syystä A:n kanssa sattuneen erimielisyyden jälkeen B oli myöhemmin samana päivänä hankkinut aseen ja ajattanut itsensä lossille, jossa hän oli tiennyt A:n olevan ja ampunut A:ta seurauksin, että A oli vahingoittunut. Tämän katsottiin sattuneen TVL 4 §:n 1 momentin 1-3 kohdassa tarkoitetuissa olosuhteissa ja A:lla oli siten oikeus TVL:n mukaiseen korvaukseen. Tapaturmalautakunnan päätöstä ei muutettu.
