KELA:n samoilla päätöksillä oli vakuutetulle myönnetty perhe-eläkkeen lisäosaa ja eläkkeensaajien asumistukilain mukaista asumistukea. KELA haki vakuutusoikeudelta päätösten poistamista. Perhe-eläkkeen lisäosaa koskevilta osin vakuutusoikeus poisti päätökset. Sitä vastoin vakuutusoikeus jätti toimivaltaansa kuulumattomana tutkimatta hakemuksen eläkkeensaajien asumistukea koskevilta osin, koska eläkkeensaajien asumistukilain 10 §:n 2 momentin mukaan lainvoimaisen eläkkeensaajien asumistukea koskevan päätöksen poistamista koskevan hakemuksen tutkii tarkastuslautakunta.
