The Insurance Court partially allowed the claimant's request to recover overpaid pension benefits totaling 37,197.68 marks resulting from an administrative error. The court determined that since the excess payment was not caused by the recipient's fraudulent conduct, it was reasonable to waive three-quarters of the recovery. Consequently, only one-quarter of the overpaid amount was ordered to be returned to the pension fund.

Eläkelaitoksessa tapahtuneen virheen johdosta vanhuuseläkettä oli maksettu liikaa 800 mk/kk 1.3.1980 alkaen. Eläkettä oli suoritettu virheellisesti yhteensä 37.197,68 markkaa ajalta 01.03.1980-28.02.1983. Koska aiheettomasti maksetun edun ei ollut esitetty johtuneen eläkkeensaajan vilpillisestä menettelystä pidettiin kohtuullisena, että liikaa maksetusta edusta jätetään kolme neljäsosaa takaisin perimättä.
