The Court of Appeal dismissed the conviction for aiding tax evasion against an employee who failed to withhold tax from his salary. The prosecution argued that the employee's prior expression of intent to receive tax-free pay constituted intentional assistance under the Penal Code. However, the court found that the employee's omission was a direct consequence of the employer's failure to withhold, not an independent criminal act. Consequently, the conviction for aiding the employer's crime was overturned as the employee lacked the requisite intent to assist in a separate criminal offense.

Työntekijän katsottiin RL 5 luvun 3 §:n 1 mom:ssa tarkoitetulla kehotuksella tahallaan edistäneen toimitusjohtajan syyksi EPL 62 §:n nojalla luettua veropetosta ja hänet tuomittiin avunannosta veropetokseen.
