Syytetty oli tuomittu Ruotsissa useista rikoksista rangaistukseen ja kärsinyt rangaistuksensa vähäistä osaa lukuun ottamatta Ruotsissa. Suomessa tehdystä rikoksesta rangaistusta mitattaessa sovellettiin rikoslain 6 luvun 2 §:n 4 kohdan koventamisperustetta, koska uuden Suomessa tehdyn rikoksen ja aikaisemman rikollisuuden suhde osoitti tekijässä ilmeistä piittaamattomuutta lain kielloista ja käskyistä.
