Tuomittu oli hakenut muutosta raastuvanoikeuden päätökseen ja samalla pyytänyt, että hänelle myönnetään hovioikeudessa maksuton oikeudenkäynti ja määrätään avustaja. Hän oli myöhemmin peruuttanut valituksensa. Valituksen peruuttamisesta huolimatta pyyntö maksuttoman oikeudenkäynnin saamiseksi ja avustajan määräämiseksi tutkittiin. (Ään.)

Eri mieltä ollut jäsen katsoi peruutuksen johdosta lausunnon antamisen rauenneen myös maksuttoman oikeudenkäynnin osalta.
