Ulkomaalaisen vapaudenmenetys oli johtunut hänen syykseen luetusta rikoksesta ja jatkunut varsinaisen pidätysajan jälkeen maastakarkoitukseen liittyneistä syistä. Vapaudenmenetystä vastaava aika otettiin kokonaisuudessaan huomioon RL 3 luvun 11 §:n nojalla rangaistuksen vähennyksenä.
