The court dismissed the plaintiff's request for the defendant to vacate a shared residence under HVL 12. A ja B olivat yhteisesti vuokranneet asuinhuoneiston, jossa he olivat kahden yhteisen lapsensa kanssa eläneet avioliittoa solmimatta jatkuvasti avioliitonomaisissa olosuhteissa yhteisessä taloudessa. Välien rikkouduttua vaati A, että B HVL 12 §:n säännöstä soveltaen velvoitetaan muuttamaan huoneistosta.

Kanne hylättiin, koska mainittu säännös koski aviopuolisoja eikä sitä katsottu voitavan soveltaa ns. avopuolisoihin.
