Jos kahdeksaatoista vuotta nuorempi vahingon aiheuttaja ei ole sitoutunut tai muutoin suostunut korvaamaan aiheuttamaansa vahingon koko määrää, on tuomioistuimen omasta aloitteestaan vahingonkorvauslain 2 luvun 2 §:ssä säädetyt kohtuullistamisperusteet huomioon ottaen harkittava maksettavaksi tuomittavan korvauksen kohtuullisuus.
Vastaajan ei voitu katsoa alioikeuden istunnoista poisjäämällä myöntäneen vakuutusyhtiön korvausmäärän kohtuullisuutta ja siten suostuneen maksamaan koko vaadittua määrää (vastaaja ei myöskääm vastannut kantajan muutoksenhakemukseen). (Ään.)
