Rental increase notice invalid due to late objection; effective date shifted to two months after notice.
Legislator summary
AI generatedThe Court of Appeal ruled that the tenant's objection to the rent increase was not served within the statutory one-month period required by law. Consequently, the court determined the increase could not take effect from the date originally proposed by the landlord. The effective date was therefore adjusted to the beginning of the rental period two months after the tenant's late objection was served.

Tuusulan KO on päätöksessään 26.10.1977 lausunut, että vuokranantaja A oli 20.6.1977 kirjallisesti ilmoittanut vuokralaiselleen B:lle vuokran korottamisesta ja kuukauden kuluessa korotusilmoituksen tekemisestä saattanut asian tuomioistuimen tutkittavaksi jättämällä haastehakemuksen tuomiokunnan arkistoon.
Sen vuoksi KO vahvistaessaan korotetun vuokran määrän on vahvistanut korotuksen tulevan voimaan 1.9.1977 lukien.
B haki muutosta.
HO: Koska haastetta jutussa ei ole annettu tiedoksi kuukauden kuluessa korotusilmoituksen tekemisestä eikä vuokrankorotusvaatimusta siten ole saatettu tuomioistuimen tutkittavaksi HVL 49 §:n 3 mom. säädetyssä ajassa, KO:n hyväksymä korotus määrättiin tulevaksi voimaan sen vuokranmaksukauden alusta, joka lähinnä alkaa 2 kuukauden kuluttua korotusilmoituksen tekemisen korvaavasta haasteen tiedoksiantamisesta eli 1.11.1977 lukien.
