A oli huoltoaseman pihalla ohjannut auton käynnistämistä varten hinauksessa ollutta henkilöautoa ja tällöin menetellyt niin varomattomasti, että hän oli menettänyt sen hallinnan, jolloin hinattava auto oli törmännyt bensiinin jakelumittariin.

Koska A:ta oli pidettävä, hänen ohjatessaan hinattavaa autoa yleiseen liikenteeseen käytetyksi katsottavalla alueella, liikenteessä olevan moottoriajoneuvon kuljettajana, hovioikeus tieliikenneasetuksen 5 §:n 1 momentin ja tieliikennelain 6 §:n 1 momentin nojalla tuomitsi A:n varomattomuudesta liikenteessä sakkorangaistukseen.
